Terms of Service

This is a static fallback. The full, localised Terms of Service (English / German / French) are available inside the app at brevetcycling.club/terms. The German version is binding for users in Germany, Austria and Switzerland.

1. Acceptance

By creating an account or accessing Brevet Cycling Club ("the Service"), you accept these Terms of Service. If you do not accept them, please do not use the Service. Mandatory consumer rights remain unaffected.

2. Service Description

Brevet Cycling Club is a browser-based virtual cycling platform with a companion mobile app. It provides physics simulation, fitness analytics, AI-supported coaching feedback and multiplayer features. Currently free in its core configuration; future paid features will be marked clearly.

3. Acceptable Use

No data manipulation, bot use, unauthorised access, abuse of the platform or unlawful content.

4. No Medical Device โ€” Health Disclaimer

Brevet Cycling Club is not a medical device within the meaning of Regulation (EU) 2017/745. Fitness metrics and AI coaching recommendations are mathematical approximations, not medical advice. Consult a physician before training if unsure. Use at your own risk.

5. AI Training Reviews

AI coaching is processed on Brevet's own self-hosted infrastructure (Ollama / Gemma) inside the European Union. No third-party AI cloud receives your data. Each request requires explicit consent.

6. Liability

Unlimited liability for intent, gross negligence and personal-injury damages. Limited to typical foreseeable damage for breach of essential contractual obligations under simple negligence. Mandatory consumer protection unaffected.

7. Changes

We notify material changes at least 30 days in advance with right of objection. Continued use is treated as acceptance only when we explicitly informed you about the change, deadline and consequences (per ยง308 No. 5 BGB).

8. Governing Law

German law applies, excluding the CISG. Consumers in the EEA additionally enjoy the protection of mandatory provisions of their country of residence (Art. 6 Rome I) and may sue at their place of residence (Art. 17โ€“19 Brussels Ia).
